Jaipur, Aug. 21 -- The one state one election plan is on backfoot as the state election commission has started preparation to finish the polling in due panchayats and municipality wards in two months, officials said on Wednesday. State election commissioner, Madhukar Gupta, said, "The one state one election is not legally feasible now. As the high court has also directed us to conduct the polling in due wards and panchayats, we have started the preparation of polling. The election could be finished in two months for which we will issue the notification in a few weeks." He further added: "We are preparing the draft electoral roll. The polling is due in around 11,000 panchayats and 150 municipality wards. We will also conduct the poll in the ones whose tenure will be over in the next two months." The development comes weeks after the Rajasthan high court on Saturday slammed the state government for not holding the polling in outgoing wards and panchyats and directed to conduct elections as soon as possible. "In the name and interest of delimitation, the Government cannot postpone the entire election process of the Panchayati Raj Institutions indefinitely, contrary to the mandate contained under Article 243-E of the Constitution of India and Section 17 of the Act of 1994. The entire exercise of delimitation should have been completed prior to the expiry of the term of the Panchayats or within six months of the dissolution of these Panchayati Raj Institutions," read a copy of the order passed by a single bench of the high court presided over by justice Anoop Kumar Dhand. It also read, "The principle of democratic governance at the grass root level is fundamental to the functioning of the Panchayati Raj Institutions and adherence to constitutional timelines is essential for the health of local democracy. The Government and relevant Authorities are duty-bound to ensure that the delimitation process is completed in a timely manner, allowing elections to be conducted as per the constitutional mandate." Calling the appointment of the administrators in the areas a sheer violation of the constitution, it said, "The instant cases are a glaring example of violation of the Constitutional mandate, wherein the petitioners were permitted to hold the post of Administrator to manage the day-to-day affairs of their respective Panchayats and even after expiry of more than six months of dissolution of their respective Panchayats, the petitioners are allowed to continue on the post of Administrator. But, subsequently they have been removed without adhering to the provisions and procedure prescribed under the law." "Prolonged postponement of these elections can result into a governance vacuum at the local level, adversely affecting the delivery of services and developmental activities at the grass root level. This Court hopes and trusts that the Government of Rajasthan will look into the matter and address the issue promptly and will further ensure that elections of the Panchayati Raj Institutions are conducted at the earliest opportunity," the order read. Aiming for a simultaneous election in the panchayats and the civic bodies in Rajasthan, the state government on Saturday issued an order directing to conduct a fresh delimitation survey of the 11,954 existing panchayats and 158 wards by July and appointed administrators to run the official works during the period for a period of six months. Meanwhile, a cabinet sub-committee was also formed under the supervision of the social justice minister Avinash Gehlot to oversee the process and submit a report to the chief minister Bhajan Lal Sharma to take the final decision on polling. After they submitted their report last month, the urban development minister Jhabar Singh Kharra declared that the polling in all panchayats and wards will be conducted altogether by December 31. Commenting on the latest development, Gehlot said, "We have sought the order passed by the high court. The government was anyway under process to conduct polling. Further decision will be taken after reviewing the order." UDH minister Jhabar Singh Kharra during a press conference said, "The government is all set to conduct the election in December only as declared earlier for which notification will be issued in October-November. It will be done as per the idea of one state one election. We are reviewing the court's order. Decisions will be taken accordingly."
