Man gets bail in Pocso case, ordered not to use social media for 1 year
JODHPUR, May 27 -- The Rajasthan High Court on Tuesday granted bail to a 20-year-old man accused in a child abuse case, but ordered that he refrain from using any social media for one year as a condition of release, a lawyer familiar with the matter said.
Justice Ashok Kumar Jain passed the order while granting bail in a case filed under Sections 78(2) and 79 of the Bharatiya Nyaya Sanhita and Sections 11 and 12 of the POCSO Act. The prosecution says the complaint, lodged on February 22 by the father of the girl, alleges the accused sexually harassed and cyberstalked the victim between February 1 and February 20, causing psychological distress and disrupting her daily life. The accused was arrested on February 24 and a chargesheet has been filed.
Counsel for the accused argued that, aside from oral allegations, no material had been produced to substantiate the charges and that the investigation had been completed, so custodial interrogation was unnecessary. Counsel for the complainant and the public prosecutor opposed bail, saying the accused had harassed the victim with sexual intent through cyber means, seriously affecting her mental well-being.
While granting bail, the court said: "The petitioner shall not directly or indirectly contact the victim or her family and shall not forward or send any message through any communication medium...The petitioner is restrained from using all kinds of social media platform...for a period of one year and, in case it is found that he is using any social media platform during the said period of one year, either in his own name or under any fictitious name...then the bail order shall be recalled."...
