JODHPUR/JAIPUR, July 16 -- The Rajasthan high court on Wednesday observed that the State Election Commissioner had prima facie violated its order on implementation of elections to Panchayati Raj institutions and urban local bodies and directed the commissioner to appear before the court, either physically or virtually, on Thursday. A division bench comprising Acting Chief Justice Sanjeev Prakash Sharma and justice Sanjeet Purohit also summoned the secretary-advisor of the OBC Commission constituted for political reservation to remain present before the court. The matter has been listed for further hearing on Thursday. The bench observed: "The State Election Commissioner, as per Article 243K, was required to implement the order of this Court. Prima facie, we find him violating the order passed by this Court." The proceedings arose out of two writ miscellaneous applications filed by the State Government seeking extension of time for complying with the directions issued by the high court in its earlier judgment concerning the conduct of elections to Panchayati Raj institutions and urban local bodies. In its application, the State Government informed the court that it required additional time to complete the process relating to political reservation for OBCs, stating that the exercise was being undertaken through the OBC Commission. The application also enclosed the court's earlier order, by which the division bench had directed the State Election Commission to complete the election process for all local bodies by July 31, 2026. The court had required the State to undertake the exercise relating to OBC political reservation in accordance with law and ensure that the election process was not delayed beyond the period permitted under the Constitution.
