HC stays state govt's order restructuring excise dept
JODHPUR, June 12 -- The Rajasthan high court on Thursday stayed the implementation of the state government's recent decision to restructure the excise department and create a new Excise Enforcement and Preventive Force, holding that the exercise cannot proceed through an executive order without first framing the necessary service rules.
Justice Chandra Prakash Shrimali passed the interim order on a petition filed by the Rajasthan Aabkari Seva Sangh, which challenged a June 1 order issued by the finance (excise) department.
The order sought to reorganise the department's administrative structure by merging the General and Preventive branches and establishing a new enforcement setup across the state. According to the petition, the government, without amending or repealing the existing rules, issued administrative orders creating a new enforcement structure.
The bench stayed the order and directed that status quo be maintained until either new service rules are framed or further orders are passed by the court. The matter has been listed for further hearing on July 7....
