JODHPUR, Aug. 1 -- The Rajasthan High Court on Thursday directed the Investigating Officer to promptly examine and act on any complaint alleging witness intimidation, coercion, social boycott or threats in connection with an FIR arising out of alleged caste-based ostracism in Jodhpur. The Court observed that any attempt to influence witnesses or obstruct the investigation would amount to a serious interference with the administration of criminal justice and must be dealt with strictly in accordance with law. Justice Farjand Ali passed the order while disposing of a criminal miscellaneous petition filed by Rajaram Paliwal, a resident of Lolawas in Luni, Jodhpur. The petitioner had sought directions for a fair and impartial investigation into FIR registered at Police Station Luni for offences under Sections 308(2), 127(2), 61(2) and 308(7) of the Bharatiya Nyaya Sanhita, 2023. According to the order, the FIR alleges that after the complainant married Rajni on December 3, 2022, according to customary rites, he and his family were ostracised by members of the Paliwal community on the allegation that his wife belonged to another caste. The complaint further alleges that community meetings were held during which the family was confined, humiliated and threatened with social boycott. It also claims that the complainant was forced to pay Rs. 1 lakh as a penalty and was later asked to pay another Rs. 21 lakh. The FIR further alleges that relatives were warned against maintaining social relations with the family and that the continuing harassment caused severe distress.
