HC orders change in IP after probe into theft gets influenced by tantrik
Jodhpur, May 21 -- The Rajasthan high court on Wednesday ordered a change of the investigating officer in a theft case from Nagaur after observing that a police probe cannot be influenced by the indications of an occultist or "tantrik".
The high court observed that an investigation cannot be based on the indication made by an occultist. The bench directed the Nagaur superintendent of police to replace the present investigating officer and hand the probe to an officer not below the rank of sub-inspector from another police station. The exercise must be completed within 15 days.
The order was delivered by justice Munnuri Laxman while allowing a criminal miscellaneous petition filed by 80-year-old petitioner Khemi Devi, a resident of Shri Balaji Nagar in Nagaur district. According to the petition, the woman had lodged an FIR reporting the theft of ornaments belonging to her and her daughter-in-law. During the investigation she provided names of suspects, but the police allegedly failed to trace either the accused persons or the stolen jewellery.
The petitioner told the court that the investigating officer had taken the father of Devi's daughter-in-law and village elders to an occultist in Alwar district. The occultist allegedly indicated that the father of the daughter-in-law was involved in the theft, following which the police began proceeding against him. The petitioner contended that the investigation had become tainted because it was allegedly being guided by the occultist's indication instead of evidence collected during the inquiry.
The prosecutor submitted, citing a status report from the Nagaur superintendent of police, that the investigating officer had interrogated all suspected persons and had visited several places, including the location of the occultist in Alwar district....
