HC directs cop to pay Rs.2 lakh for keeping man in custody illegally
JODHPUR, June 13 -- The Rajasthan High Court on Friday directed a Tehsildar to personally pay Rs.2 lakh compensation to a Nagaur man who remained in custody despite an appellate authority suspending his sentence, holding that the continued detention violated his fundamental right to personal liberty under Article 21 of the Constitution. The Court also ordered a departmental inquiry against the officer and directed that he be removed from his field posting pending the inquiry.
The order was passed by a Division Bench comprising Justice Farjand Ali and Justice Sunil Beniwal in a habeas corpus petition filed by Bhanwari Devi, wife of Ghamandnath, a resident of Nayagaon village in Nagaur district.
The petitioner alleged that her husband continued to remain confined even after the Additional Divisional Commissioner, Ajmer, suspended the sentence of civil imprisonment imposed on him in revenue proceedings....
