HC directs allotment of plots to Pak, B'desh, Afghanistan migrants
JODHPUR, Oct. 9 -- The Rajasthan high court has directed authorities to allot residential plots under Vinoba Bhave Nagar Scheme in Jodhpur to migrants from Pakistan, Bangladesh and Afghanistan at concessional rates through hire-purchase agreements or monthly instalments, taking into account their limited financial means.
A division bench of Justice Vinit Kumar Mathur and Justice Chandra Shekhar Sharma passed the order on Wednesday while disposing of an application filed by Visthapit Hindu Punarwas Samiti. The bench noted the migrants covered by the petition had come to India under extreme hard condition and were staying in Jodhpur. It noted Jodhpur Development Authority or Municipal Corporation had already framed the Vinoba Bhave Nagar Scheme for providing residential plots to such migrants at concessional rates.
The bench observed, 'this Court is of the considered view that since it is an admitted position that the members of the petitioners- Samiti are the migrants, who have come from Pakistan, Bangladesh and Afghanistan under the extreme hard conditions and are staying in Jodhpur', the ends of justice would be met by extending the facility of payment through instalments. The court directed the respondents to allot the plots at concessional rates on a hire-purchase basis or through monthly instalments. It said that since the Housing Board and other state functionaries were already following such a procedure for allotment of plots, adopting same procedure, the benefit thereof may be extended to the migrants of the petitioners- Samiti.The court, however, made it clear that the authorities could impose conditions already prevalent for securing the amount payable for the plots.
The petitioners told the court that although authorities were willing to allot residential plots at concessional rates, the migrants, due to their poor financial condition and limited sources of income, were unable to pay the entire amount in one go. They sought allotment through hire-purchase agreements or monthly instalments....
