HC appoints committee led by ex-CJI for ACCSL liquidation
JODHPUR, Aug. 1 -- The Rajasthan High Court has appointed a committee headed by former Chief Justice of India Justice (Retd.) Sanjiv Khanna to oversee and expedite the liquidation of Adarsh Credit Cooperative Society Limited (ACCSL) and the process of refunding money to its investors. The Court also vacated all interim orders granted in favour of the petitioners, erstwhile management and shell companies in the connected matters.
Justice Sameer Jain passed the order on July 28 while hearing a batch of interconnected petitions relating to ACCSL. The petitions involved grievances raised by individual investors, groups of investors, successive purchasers of auctioned properties, the erstwhile management, office bearers and other stakeholders.
The Court described the alleged scam as being of staggering magnitude, involving approximately Rs.25,000 crore, comprising Rs.10,000 crore in principal and Rs.15,000 crore in interest, as claimed by investors. The bench observed: 'A highly systematic white-collar crime has been perpetrated against millions of poor investors', involving high interest rates, heavy commissions to intermediaries and diversion of funds into real estate through shell companies allegedly controlled by friends and relatives of the management.
The bench noted that the Enforcement Directorate had attached properties under the Prevention of Money Laundering Act with the present market value of Rs. 5,000 crore, while further properties were yet to be identified and attached for settling investors' claims....
