HC: S.H.O. must examine probe before filing charge sheet
JODHPUR, July 20 -- Holding that a Station House Officer (SHO) has a legal duty to independently examine an investigation before filing a charge sheet, the Rajasthan High Court has restored criminal proceedings against a police officer after setting aside a revisional court order that had quashed cognizance against him.
The Court also directed the state and the Director General of Police to issue instructions to all SHOs in Rajasthan that they must not act like a post office while forwarding investigation reports to courts, a lawyer familiar with the case said on Saturday.
Allowing a criminal miscellaneous petition filed by Rajendra Prasad, Justice Anoop Kumar Dhand held that a prima facie case existed against respondent Dharam Singh Meena, the then SHO of Mundawar Police Station, under Sections 166 and 167 of the IPC for allegedly failing to discharge his supervisory responsibilities during investigation....
