Gurugram, Nov. 3 -- Gurugram police on Monday filed a chargesheet against two men accused of deliberately ramming their car into a motorcycle ridden by Delhi woman Shivani Chauhan, alias Sia, during a road-rage incident on Golf Course Road on September 13. Police retained the attempt-to-murder charge. The accused, Kalyan Bainsla, 33, and his cousin Lavnish, 34, both from Palwal, were arrested in Dausa, Rajasthan, on September 15. Inspector Sukhpal, station house officer of Sector 56 police station, confirmed the chargesheet filing. "The attempt-to-murder charge under Section 109(1) of the Bharatiya Nyaya Sanhita (BNS), invoked in the FIR against Kalyan and Lavnish, has been retained in the chargesheet," he said. Charges under Sections 78 (stalking) and 79 (word, gesture or act intended to insult the modesty of a woman) were also retained against the two men. According to police and footage posted by Sia, the incident took place on September 13, when she was riding a motorcycle with other bikers on Golf Course Road. Kalyan, driving a Maruti Ciaz, allegedly approached her, tried to speak to her and made obscene gestures and comments. Sia said she gestured to him to maintain distance to avoid a collision and sped away to avoid them. Kalyan allegedly chased her and changed lanes to ram her before fleeing. The incident came to light after Sia posted footage recorded by her helmet-mounted camera on social media. It showed her motorcycle falling after being hit by the car, leaving her injured. Other bikers attempted to stop the car at a traffic signal, but the driver sped away. Gurugram police registered a suo motu FIR the same day at Sector 56 police station under Sections 125 (act endangering life or personal safety of others) and 281 (rash driving) of the BNS. A special investigation team was formed, which added Sections 109(1) (attempt to murder), 78 (stalking), 79 (word, gesture or act intended to insult the modesty of a woman) and 3(5) (common intention) to the FIR. Assistant commissioner of police (crime against women) Shushila said investigators examined recordings from more than a dozen CCTV cameras at locations along the route, footage from Sia's helmet-mounted camera and video recorded by fellow riders. "Approval from senior authorities was sought before the chargesheet was prepared with attempt-to-murder charges," she said. Sia, speaking to HT on Monday, said she was glad that Gurugram police had retained the charges in the chargesheet. "Police did not let the two get bail from court by opposing their applications vehemently. Such people should fear the law. Since the incident, I have not been able to ride a bike. I suffered a ligament tear in my left knee in the crash," she said....
