Rights panel seeks report on ASI for 'wrongful detention'
Rohtak, Oct. 23 -- The Haryana Human Rights Commission (HHRC) has sought a detailed report by December 17 from Bhiwani SP Sumit Kumar regarding the conduct of assistant sub-inspector (ASI) Virendra Singh of Sadar police station for allegedly threatening, detaining, and wrongfully confining a man, Ashok Kumar, on the basis of a "false complaint" filed by his brother on June 13 this year.
The commission acted after Ashok Kumar, a resident of Dhana Janga, lodged a complaint accusing ASI Virendra Singh of summoning him to the police station on June 13, where he was allegedly threatened and made to sit from morning till evening without any formal arrest.
A case was registered under Sections 126 and 170 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), which deal with preventive detention in situations posing imminent threats to public safety. Justice Lalit Batra, chairperson of the HHRC, observed that preventive provisions are not punitive in nature and can only be invoked under strict conditions, citing the Supreme Court's ruling in Rajender Singh Pathania vs State (2011).
The panel directed SP Sumit Kumar to examine whether due legal procedure was followed while summoning Ashok Kumar, the justification for his prolonged detention, and whether preventive action was warranted. htc...
