NGO moves court over 'non-compliance' with NGT orders
Mohali, Aug. 17 -- The Environment Protection Society has moved an application before the executing court alleging non-compliance with National Green Tribunal (NGT) directions on protecting trees from concretisation, and alleged irregularities in deconcretisation work worth Rs.2.5 crore by the Mohali municipal corporation (MC).
"The court has sought a reply from the MC commissioner on penalty proceedings that did not start after repeatedly filing false compliance affidavits," said HS Minhas, retired chief engineer and president of the society. "Our concern is not only protection of trees but also accountability for public funds. If work has not been executed despite tenders being floated and payments being released, the matter should be independently investigated," he said.
The society has sought initiation of appropriate proceedings under Sections 26, 27 and 28 of the NGT Act.
The application, filed in execution petition no. ex. 34 of 2022 before the court of civil judge (senior division), Mohali, Rupinder Singh, seeks, among other directions, that the matter relating to the suspected release of public funds be referred to the Punjab vigilance bureau or the enforcement directorate for investigation.
The society has alleged that an affidavit filed on July 21, 2026, claiming compliance with deconcretisation work in Sectors 52, 53, 54, 55 and other areas, was contrary to the ground situation.
According to the application, the NGT had, in its 2019 order, directed that concrete or bitumen within one metre of the trunk of trees be removed and that trees which had died due to concretisation be replaced.
The society has further sought sector-wise compliance affidavits detailing the number of trees identified, those requiring deconcretisation, trees actually deconcretised, dates of execution and geo-tagged photographs before and after the work....
