HC raps judicial officers over 'casual orders' in a drugs seizure case
Chandigarh, Aug. 22 -- The Punjab and Haryana high court has rapped judicial officers of district court, Sirsa for passing orders in a drugs seizure case in "a casual and cavalier manner".
".from the perusal of various zimni orders passed by the trial court, it is apparent that various presiding officers of the court have passed the orders in a very casual and cavalier manner. It can never be expected that the judicial officers, who are presiding over a court of cases registered under the provisions of NDPS Act shall perform their duties in such a casual manner," the bench of justice NS Shekhawat observed while asking the sessions judge, Sirsa to convene a meeting of all judicial officers of the district and to direct them to take the court proceedings "seriously". The sessions judge has also been told to file a compliance report of the same.
The court was dealing with a bail plea of one Bhagirath from Sirsa pending since 2021 while he was on interim bail. The FIR was registered in April 2021 and the accused got interim bail in August 2021.
From the record, it had come to fore that the challan was presented in the case on June 10, 2021 and charges were framed on March 8, 2022. However, in spite of lapse of more than three years and five months no prosecution witness was examined.
"It is always expected that the judicial officers will adopt a sincere approach in dealing with sessions trials. Even no leniency should be shown towards the accused, who are facing charges of smuggling of drugs," the court further added while disposing of the plea and also directing that the order be also placed with the administrative judge (of high court) of Sirsa district....
