India, Sept. 16 -- T he Delhi High Court has dismissed a plea by Vimal Elaichi maker PB Agro LLP against Maharashtra FDA notices to Shah Rukh Khan, Ajay Devgn and Tiger Shroff over alleged surrogate advertising. Justice Swarana Kanta Sharma said the company had "failed to establish that any substantial or material part of the cause of action has arisen" in Delhi. "The petition is therefore dismissed on this ground, without expressing any opinion on the merits of the petitioner's challenge," the court said. The Maharashtra FDA had on August 11 asked the three actors to stop endorsing Vimal Elaichi, alleging that the advertisements amounted to surrogate promotion of Vimal Pan Masala, a product prohibited in Maharashtra. It also sought details of the due diligence undertaken by the actors before endorsing the product. PB Agro argued that the advertisements were visible in Delhi as well as Maharashtra and maintained that the campaign promoted only its cardamom product.
