SC rejects Sun Pharma plea in Intas' 'Bevatas' trademark row
New Delhi, July 28 -- The Supreme Court on Monday dismissed Sun Pharma Laboratories' appeal against a Delhi High Court judgment permitting Ahmedabad-based Intas Pharmaceuticals to manufacture and market its anti-cancer drug under the trademark 'Bevatas', saying that there was no likelihood of confusion with Sun Pharma's registered trademark 'Bevetex'.
A bench headed by Chief Justice of India Surya Kant and comprising justices Joymalya Bagchi and V Mohana affirmed the high court's finding that the rival marks did not create a likelihood of confusion among the relevant class of consumers, including oncologists, chemists, trained nurses, patients and their attendants.
