Kolkata, Sept. 25 -- A division bench of the Calcutta high court on Friday set aside an order of the single bench which had ordered that the Congress' candidate for the upcoming by-election in Nandigram on October 6 should not be treated as arrested in a 2007 case.

The division bench, headed by chief justice Ravindra Vithalrao Ghuge, expressed surprise at the protection granted to Milan Pradhan, the arrested candidate, by a single-judge bench on Thursday.
