Karnataka HC upholds police power to debit-freeze accounts under Section 106 BNSS without prior judicial order
Bengaluru, Aug. 12 -- In a landmark decision on the operation of the Bharatiya Nagarika Suraksha Sanhita, 2023 (BNSS), the High Court of Karnataka, presided over by Justice M. Nagaprasanna, has upheld the statutory authority of police officers to debit-freeze bank accounts during crime investigations under Section 106 BNSS without obtaining a prior judicial order, said Pranab Mohanty, Director General of Police, Karnataka Cyber Command, Bengaluru.
The police official said that under this provision, police officers are required only to freeze the account during investigation and report the action forthwith to the jurisdictional Magistrate.
