Patna, Sept. 29 -- The Patna High Court has quashed an order of the Banka District Magistrate declaring a resident an "anti-social element" and directing him to remain at a police station for seven hours daily, holding that such executive actions amounted to an unjustified interference with his fundamental right to life and personal liberty.
A division bench of Justice Rajeev Ranjan Prasad and Justice Sunil Dutta Mishra directed the Bihar government to pay Rs 1 lakh as compensation and Rs 10,000 towards litigation costs to petitioner Girdhari Yadav, a resident of Katoria in Banka district.
