Shimla, Jan. 6 -- The Himachal Pradesh High Court on Monday delivered a verdict upholding the power of Forest and Police Officers under Section 42 of the Indian Forest Act to arrest an accused without a warrant.
HC also decided that the previous verdict passed by a single bench was bad in law, which held the offence non-cognizable.
A division bench of Justice Vivek Thakur and Justice Romesh Verma was entrusted by Chief Justice Gurmeet Singh to decide the moot questions of jurisprudence, whether Section 42 of IFA is a non-cognizable Offence.
