Shimla, April 10 -- In a significant and far-reaching ruling, the Himachal Pradesh High Court has held that amendments denying pension to disqualified Members of the Legislative Assembly (MLAs) cannot be applied retrospectively, rejecting the State government's contention to enforce the law from a back date.

A Division Bench comprising Justice Vivek Singh Thakur and Justice Ranjan Sharma ruled that the amended provisions would apply only prospectively to members elected to the 14th Legislative Assembly and thereafter.

The court made it clear that MLAs elected during the 12th and 13th Assemblies would continue to be governed by the earlier legal framework and remain entitled to pension benefits.
