Sri Lanka, May 31 -- On or about June 11, 1992 the Sunday Observer and Janatha newspapers published two articles titled "Army clean up exposes Rs. 8 million racket, Welfare Fund Colonel sacked" concerning Colonel (Rtd) Mahinda Dissanayake.
Subsequent to the publication of the said articles, Colonel (Retd.) Mahinda Dissanayake instituted action before the District Court of Colombo wherein judgment was initially entered in his favour awarding damages in a sum of Rupees 3,000,000.00. On appeal, the said judgment was set aside by the Court of Appeal, following which Colonel (Retd.) Dissanayake preferred a Special Leave to Appeal application to the Supreme Court.
