Kolkata, Oct. 12 -- The Kolkata Municipal Corporation (KMC) has made disclosure of pending court cases and tribunal proceedings mandatory for property owners seeking relief under its property tax waiver scheme, warning that suppression of such information could prompt legal action, including a move to seek dismissal of the pending case.
According to KMC officials, the Municipal Commissioner has issued a circular directing taxpayers applying under the Kolkata Municipal Corporation Incentive (Waiver of Interest and Penalty to the Property Tax Payers) Scheme, 2026, to disclose any pending litigation or restraining order relating to annual valuation, assessment or consequential property tax demands.
Further, applicants must withdraw such proceedings before availing themselves of the waiver. If the corporation finds that litigation has not been disclosed or withdrawn, it may withhold the waiver letter of intimation until the proceedings are formally withdrawn.
An official said that the circular issued in this regard further states that if a taxpayer is found to have availed of the scheme by suppressing an existing court case, the matter must immediately be referred to the KMC Law department. The department has been directed to place the matter before the concerned High Court bench and explicitly seek dismissal of the pending case.
To facilitate withdrawals, taxpayers with pending cases before the Municipal Assessment Tribunal (MAT) have been asked to contact Deputy Municipal Commissioner (Revenue) Abhishek Maikra, who will coordinate the process.
The scheme, which came into effect on October 8, offers waivers on interest and penalties on outstanding property tax bills raised up to June 30, 2026. It will remain valid until March 31, 2027, with a possible extension.
The initiative has been rolled out to help property owners clear long-pending tax dues through a one-time settlement.
