Kolkata, Sept. 25 -- The Calcutta High Court on Friday directed the Kolkata Municipal Corporation (KMC) to ensure that illegal constructions once razed shouldn't get reconstructed.
A division bench headed by Chief Justice Ravindra Vithalrao Ghuge is learnt to have asked the Municipal Commissioner and administrator Smita Pandey to ensure the same. The hearing was over allegations that construction had resumed at a site after an unauthorised structure there had been demolished following the court's directions.
The court expressed dissatisfaction with the KMC counsel's lack of information about the matter.
The Chief Justice said that, based on his experience of handling cases involving several municipal corporations in Maharashtra, commissioners were often not given complete information about developments on the ground.
The bench said that once an unauthorised structure was demolished pursuant to a court order, the municipal authorities must ensure that construction did not resume at the site.
The case is set to be next heard on appear before it on October 14.
The court had recently ordered a CBI inquiry into illegal constructions in the city.
Petition was filed alleging unauthorised constructions in parts of Kolkata under Amherst Street and Narkeldanga police stations.
The petitioner has identified 42 properties where structures were allegedly built without proper sanction and where the ownership or identity of occupants could not be established.
