New Delhi, Oct. 21 -- The Delhi High Court on Wednesday said it would hear on October 22 a plea by All India Students' Association (AISA) president Neha Bora challenging a Delhi Police notice asking her to execute a peace bond before a Special Executive Magistrate(SEM).
Justice Subramonium Prasad deferred the hearing at the request of Bora's counsel. The plea seeks quashing of the notice and directions restraining police from taking coercive action against her.
Issued on October 17 under Section 126 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), the notice asked Bora to appear before the SEM on October 19 and explain why she should not furnish a personal bond of Rs 10,000 with one surety to maintain peace.
Bora, who was detained on October 16 while heading to join the Cockroach Janata Party's 'Lehra Do Tiranga' march, alleged that the notice was vague and unsupported by evidence.
Her petition argued that the proceedings sought to suppress peaceful dissent and violated her fundamental rights.
She was released on
October 17.
The case was listed urgently despite the court's Dussehra vacation.
