
New Delhi, July 10 -- A Delhi court has acquitted a man accused of attempting to murder his wife, holding that the prosecution failed to prove its case after the complainant died before her testimony could be recorded.
Principal District and Sessions Judge Sanjay Sharma acquitted Abhinesh Tripathi alias Rahul, who was accused of attempting to murder his wife Rashmi in 2021.
According to the prosecution, Rashmi initially alleged that her husband assaulted her with a hockey stick and later claimed he threw her from the third floor of their house while intoxicated, prompting police to add the charge of attempt to murder.
During the trial, however, Rashmi could not be traced and her father later informed the court that she had died. He also said the couple had settled their disputes before her death, obtained a divorce by mutual consent and that Rashmi had received Rs 8 lakh as alimony.
The court observed that Rashmi was the sole material witness and the remaining witnesses were only formal police witnesses, whose evidence was insufficient to establish the charges beyond
reasonable doubt.
