Kolkata, Sept. 23 -- The Calcutta High Court on Wednesday declined to decide at this stage the dispute over the eviction notice issued to the Trinamool Congress office at Camac Street and directed the City Civil Court to hear the matter on merits.
A division bench of Justice Sabyasachi Bhattacharya and Justice Sandeep Kumar Dey said the question of interim protection required detailed arguments from both sides. It directed the lower court to decide the plea concerning "injunction" or "status quo" within 15 days of the resumption of normal judicial proceedings after the Durga Puja vacation.
The dispute concerns the party office occupying the seventh and eighth floors of the building. The building owner, Ramadevi Goenka, had challenged the City Civil Court's earlier order directing
maintenance of status quo.
The owner has alleged that the All India Youth Trinamool Congress took possession before obtaining the completion certificate required under its March 1, 2020 lease. She has also alleged unauthorised use of the roof, stairs and garage, installation of a billboard without permission and non-payment of rent for five months.
The court directed expeditious disposal without prejudicing either side.
