Kolkata, Sept. 30 -- The Calcutta High Court has directed police not to permit a club to organise Durga Puja in the common area of a residential building at Raja Rammohan Sarani without permission from the flat owners' association or an individual flat owner.

The court therefore directed the officer-in-charge of Muchipara police station not to permit the club to organise Durga Puja at the premises without such permission.

Justice Saugata Bhattacharyya passed the order on September 28 on a petition by five flat owners of a G+3 residential building at 133A, Raja Rammohan Sarani, under Muchipara police station. The residents had objected to Sarad Sangha club organising Durga Puja at the premises in 2026, saying the Flat Owners Association had not granted permission.

The residents had also lodged a complaint with the officer-in-charge of Muchipara police station, but submitted that no effective steps had been taken. They apprehended that the club might organise the puja forcibly.

The club submitted that it had been organising Durga Puja at the car parking space for a long period and had the permission of the erstwhile landowner to do so, including after the G+3 building was constructed.

The state told the court that no pandal had been erected at the premises till then.

The court observed that the flat owners had the right to express their views on organising Durga Puja within the premises.

It noted that the club had failed to substantiate any right to organise the puja in the common area in the absence of permission from the Flat Owners Association or an individual flat owner.
