SEC removes chief councillor of BhabuaNagar Parishad
BHABUA, April 30 -- The State Election Commission (SEC) has declared Vikas Kumar Tiwary, chief councillor of Bhabua Nagar Parishad, disqualified and ineligible for the post, and has removed him with immediate effect.
State Election Commissioner (SEC) Deepak Prasad, in an order dated April 28, said that the post of chief councillor shall be deemed vacant from the date of issuance of the order, and the process to fill the vacancy will be conducted in accordance with the rules.
The SEC has directed the District Magistrate (DM) of Kaimur-cum-District Election Officer (Municipality), Nitin Kumar Singh, to initiate legal proceedings against Tiwary under Section 447 and other relevant provisions of the Bihar Municipal Act, 2007, for allegedly submitting a false affidavit and concealing material facts. The DM has been asked to apprise the Commission of the action taken within four weeks.

Tiwary was elected to the post in December 2022. His nearest rival, Jainendra Kumar Arya, had filed a complaint (Case No. 25/2025) with the SEC under Section 18(1)(m) of the Bihar Municipal Act, seeking his removal on the grounds that he had four living children, two of whom were born after April 4, 2008. Under the Act, a candidate with more than two children born after April 4, 2008, is disqualified from contesting urban local body elections in Bihar.
In his nomination papers and affidavit, Tiwary had admitted to having four children, including two daughters, but declared that none of them was born after April 4, 2008.
After hearing both parties and considering the report submitted by the Kaimur DM-which confirmed that the dates of birth of three of Tiwary's children fall after April 4, 2008-the SEC cancelled his election.
Kaimur District Magistrate Nitin Kumar Singh said he had received the SEC order and would take action accordingly, adding that the steps taken would also be communicated to the media....
