Patna HC invalidates order of NIA court, grants bail to Kashmiri man
PATNA, Oct. 9 -- The Patna high court set aside the judgment/order of a Special Judge, NIA, which refused bail to Sarfaraz alias Muzaffar Ahmad Wani, an accused in a case concerning the alleged circulation of counterfeit Indian currency notes, and directed his release on bail.
A division bench of Justice Rajeev Ranjan Prasad and Justice Sunil Dutta Mishra delivered the verdict on October 6.
Wani, a resident of Dahmal in Anantnag, Jammu and Kashmir, was arrested from Anantnag on September 12, 2024 in a case involving the seizure of fake Indian currency notes worth Rs.1,95,000 on September 5, 2024 in East Champaran along the Nepal border.
The NIA took over the investigation on December 10, 2024, and the Special Judge, NIA, rejected his bail plea on July 15, 2025. "The appellant (Sarfaraz) shall be released on bail forthwith, subject to furnishing bail bonds to the satisfaction of the NIA trial court. The trial court may impose other conditions it deems fit and proper to secure the appellant's attendance during the trial. The impugned order is, therefore, set aside. It will be open to the trial court to secure Sarfaraz's presence during the trial, if necessary, by issuing coercive order(s) in accordance with law," ordered Justice Rajeev Ranjan Prasad and Justice Sunil Dutta.
Wani, in his defence, said he was running an e-commerce fruit business with an acquaintance from Bihar and has only dealt in legal money transactions. He stated that allegations of his involvement in peddling of fake Indian currency are totally baseless and false.
Even as time was granted to the Sarfaraz, no document showing service of grounds of arrest in writing has been placed before this Court....
