HC seeks CBI reply in Lalu plea against trial court orders
NEW DELHI, March 11 -- The Delhi High Court on Wednesday issued notice in a petition filed by Rashtra Janata Dal (RJD) chief Lalu Prasad Yadav against the trial court's order framing charges against him in the alleged land-for-job scam.
A bench of justice, Manoj Jain, sought CBI's response in Lalu's petition challenging the January 9 and February 16 trial court orders and fixed March 17 as the next date of hearing.
On January 9, the trial court framed corruption charges and criminal conspiracy charges against former Bihar chief minister Lalu Prasad Yadav, his wife Rabri Devi, and sons and daughter in the alleged land-for-jobs scam, noting that Yadav used the railway ministry as his "personal fiefdom" to carry out a criminal enterprise when he was the Union minister.
Special Judge Vishal Gogne of Rouse Avenue Court, in his January 9 ruling, added that the chargesheet revealed an overarching conspiracy wherein public employment was used by Yadav as a bargaining chip to acquire lands favorably in the name of his family members, including sons Tejashwi and Tej Pratap Yadav, wife Rabri Devi, and daughter Misa Bharti.
On February 16, the court formally framed the charges.
Justice Jain said that he would also hear on that day a pending petition filed by Lalu's close aide, Bhola Yadav, challenging the trial court's orders pardoning five accused in the land-for-job scam and allowing them to turn approver.
"Learned counsel for CBI appears on advance notice and, without prejudice to his rights and contentions, accepts notice," the court said in the order.
It also restrained the CBI from examining the approvers till it took a final call in Lalu and Bhola's petition. "The question is that the approver needs not be examined unless we hear this petition. Let it (trial) go on, you (CBI) examine others.," the bench said to CBI's lawyer, Additional Solicitor General DP Singh....
