ARA, June 21 -- Father and brother of a youth from Bhojpur district, who was killed in an encounter with police on June 17 after a 48-hour standoff, have been booked for concealing or assisting the possession of the pistol and protecting him during the police's effort to arrest him. The family of the youth claims that he was "mentally disturbed". Father Kashinath Tiwari and brother Chandan Tiwari -- both residents of Bilauti village under Shahpur police station area of Bhojpur district -- have been named under sections 132/109(1)/351(2)/352(5)/353(5) of the Bharatiya Nyay Sanhita (BNS) and sections 25(9)/27/35 of the Arms Act. Overall, police filed two separate FIRs in connection with the case: one related to the encounter in which the youth was the accused, and the other regarding the youth's firing when police went to arrest him, in which his father and brother are accused. Police accused them of possessing an illegal firearm and protecting the youth. Both FIRs were filed based on the statement of Rajesh Malakar, the then Station House Officer (SHO) of Shahpur. According to the FIR filed in the firing case, police received information that the youth possessed an illegal weapon and had publicly displayed it. Following this, a police team arrived in Bilauti village on the morning of June 17th to verify this information, recover the weapon, and arrest him. However, the FIR states that the youth became agitated whenever police tried to coax him into surrendering his weapon. "Policemen narrowly escaped being hit by bullets when he fired several rounds," says the FIR. It adds that the youth later climbed onto the roof of his house and began firing from there. The FIR, quoting the statement of SHO Rajesh Marlekar, says that the youth later ran toward a nearby wasteland and as the police team chased him, he opened fire, which the police returned in defence, targeting the accused's leg below the waist. He was immediately taken into custody and sent to Shahpur Referral Hospital for treatment, finally being admitted to the PMCH where he succumbed to his injuries. According to another FIR, the slain youth had a prior criminal history. He was a named accused in Shahpur Police Station Case No. 73/2025 (under the SC/ST Act and other serious sections).
