Delhi HC stays FSSAI ban on 'Energy Drink' label
New Delhi, Oct. 7 -- The Delhi high court on Tuesday stayed the Food Safety and Standards Authority of India's (FSSAI) order directing PepsiCo, Monster Beverage and Reliance Consumer Products Ltd to discontinue using the descriptor "Energy Drink" for their respective products and permitting the state commissioners to seize the products.
PepsiCo uses the "Energy Drink" descriptor for Sting Energy and Adrenaline Rush, while Reliance Consumer Products markets Campa Energy Drink - Gold Boost and Monster Beverage uses the descriptor for its drink Monster Energy.
A bench of Justice Amit Mahajan, however, restrained PepsiCo and Monster Energy from manufacturing any new products using the "Energy Drink" descriptor. At the same time, the court permitted the companies to sell their existing stock bearing the descriptor.
"The impugned order dated June 30 is stayed till the next date of hearing. This does not mean that the petitioners can be permitted to manufacture the product. Petitioners are permitted to sell the stock already manufactured," the court said in the order passed in Pepsi and Monster Beverage's matter. The matter will be next heard on November 5.
The three companies had moved the high court against FSSAI's June 30 order, asserting that the order was issued without issuance of any show cause notice or hearing....
