PRAYAGRAJ, July 10 -- The Allahabad high court has sought explanation from the additional principal judge of Jhansi family court as to why maintenance was granted to a woman from her first husband even after she married another person after divorce. A single bench of Justice Praveen Kumar Giri passed the order while hearing a revision petition filed by the husband challenging the family court's direction to pay Rs.10,000 per month as maintenance to his former wife. In its order dated July 7, the high court issued notice to the woman and fixed July 21 as the next date of hearing. It also directed the additional principal judge, Jhansi family court, Harish Chandra, to explain why he passed the maintenance order despite the husband's objection dated October 30, 2025, stating that the woman had remarried. Appearing for the husband, advocate Vatsala submitted that the couple were granted a divorce by the family court on July 30, 2025. She said the husband had challenged the divorce decree before the high court, but the woman remarried about a month after the decree. The counsel further submitted that the woman herself had disclosed her second marriage in an affidavit. Despite this, the family court directed the husband to pay Rs.10,000 per month to the woman and Rs.5,000 per month to their son. She argued that under Section 125 of the Code of Criminal Procedure, a divorced woman is entitled to maintenance only until she remarries.
