Raj HC upholds prison health care for Asaram
JODHPUR, June 10 -- The Rajasthan High Court has ruled that self-styled godman Asaram will continue to receive medical care and related support while serving his sentence, holding that a prisoner's right to healthcare and dignity does not end with conviction.
The order was delivered by Justice Sanjeet Purohit while disposing of a writ petition filed by Asaram, who is serving life imprisonment at Central Jail, Jodhpur, after his conviction in a POCSO case was partly upheld by a division bench of the High Court, which directed that he remain in prison for the rest of his natural life. In his petition, Asaram said several facilities previously allowed during trial and appeal were withdrawn after the appeal concluded. He also sought fresh arrangements in jail, citing his age and serious health issues.
The bench noted that Asaram was convicted by the Special Judge, POCSO Act Cases, Jodhpur Metropolitan, in April 2018, and that his conviction was partly upheld by the division bench in May 2026. It recorded that medical reports from AIIMS Jodhpur and other doctors mention serious illnesses, including heart disease, diabetes, kidney-related problems, and bone and muscle weakness.
The court referred to earlier Supreme Court and High Court orders that permitted special arrangements for him, such as food from outside sources and treatment by doctors of his choice. The bench said these arrangements were made because of his medical condition and not as any special privilege, and that they had been followed for years without any complaint of misuse.
The court ordered that all medical care, assistance and other facilities already allowed under earlier orders will continue in jail without interruption, unless there is a major change in his medical condition or a future court order. On specific requests made in the petition, the court allowed a bed and bedding inside the jail, noting medical reports that showed difficulty in movement and a risk of injury due to bone weakness, and saying the measure was necessary for health reasons rather than comfort. The court did not alter the existing arrangement of one meal a day from outside, but allowed alkaline drinking water to be supplied with it, subject to the same rules already in place....
