Jodhpur, Aug. 22 -- The Rajasthan high court has pulled up the state government and the Union government over persistent delays in providing basic judicial infrastructure, calling the issue "very critical" and seeking accountability from top officials, including a list of officers who have failed to comply with directions, a lawyer familiar with the case said on Thursday. A division bench of justices Pushpendra Singh Bhati and Dinesh Mehta was hearing a batch of petitions led by District Bar Association, Banswara & Anr. vs. State of Rajasthan & Ors. During the hearing, representatives of the Bar highlighted that courts in several newly created districts are functioning without minimum facilities. The bench recorded these concerns, noting that infrastructure that should have been provided in advance - or at least simultaneously with district creation - was still missing. Placing a detailed status note before the court, senior advocate Sachin Acharya said 174 land allotment matters for court buildings and judicial residences remain pending: 21 at the state level, 23 with the director of local bodies, and 130 with district collectors. Fresh proposals worth Rs.324.29 crore await administrative and financial (A&F) sanction, against which only Rs.10 crore has been accorded so far, despite a prior commitment to release Rs.40 crore. Revised sanctions of Rs.59.28 crore for under-construction projects, Rs.258.57 crore for facilities across court complexes, and Rs.85.04 crore for lawyers' halls and allied amenities are also pending. The court noted earlier assurances that immediate attention would be given to ladies' toilets, a creche, and facilities for pregnant women and women with minor children, along with basic amenities for court staff and litigants, including parking and shaded waiting areas. The bench said: "The repeated failure on the part of the State and Union of India in resolving the aforesaid issues is directly causing hindrance to the system of justice and required to be addressed urgently." The court directed senior advocate Acharya to supply a consolidated list on five key heads - land allotment, fresh A&F sanctions, revised sanctions for ongoing works, pending infrastructure facilities, and lawyers' halls/chambers - to the advocate general and additional solicitor general. On the next date, both law officers must assist the court with complete records, concrete steps taken or proposed, and timelines for completion. They have also been told to furnish the list of erring officers and the proposed action against them, with the bench cautioning that it will contemplate stern action if warranted.
