HC orders transfer of probe into fraudulent call centre to CBI
Jodhpur, May 13 -- The Rajasthan High Court has transferred further investigation into an alleged fraudulent call centre case to the Central Bureau of Investigation (CBI), after recording material inconsistencies and prima facie evidence that 10 young women were illegally detained overnight without any FIR being registered.
Justice Anil Kumar Upman, while hearing separate criminal miscellaneous petitions filed by the accused petitioners, directed that the probe be handed over to the CBI while disposing of the petitions. The court was hearing pleas challenging an FIR registered at Kudi Bhagtasani police station under Sections 319(2), 318(4) and 61(2)(b) of the Bharatiya Nyaya Sanhita (BNS), 2023, and Section 66D of the IT Act.
The bench directed the station house officer of Kudi Bhagtasani police station to hand over all records related to the case to the CBI within a week. The agency was asked to conduct an independent investigation and complete it preferably within six months.
The trial court was also directed to defer further proceedings until the CBI submits its report.
The controversy stems from a raid conducted on January 16, 2025, following a tip-off about a fraudulent call centre allegedly operating under names such as "Power Break Down Service India". However, after examining CCTV footage, general diary entries and affidavits, the court noted grave procedural lapses.
"It becomes abundantly clear from the foregoing sequence of events that on January 15, 2025, in the absence of any FIR and without any information regarding the commission of a cognizable offence, the police picked up as many as ten girls from their homes and brought them to the police station. Not only that, they were also illegally detained at the police station throughout the night," the court observed.
The bench noted that the FIR was registered only the next day, on January 16, 2025, at 3:37 pm....
