HC orders state to consider regulatory policy for spas
JODHPUR, Sept. 21 -- The Rajasthan high court has directed the state government to examine the need for a clear policy regulating the operation of spas and massage centres in the state. The direction came while the court was hearing a writ petition filed by the proprietor of a spa centre in Jodhpur, seeking relief from alleged harassment by local authorities.
During the hearing, a bench comprising Dr Justice Pushpendra Singh Bhati and Justice Bipin Gupta was informed by the petitioner's counsel that "there is frequent harassment of the petitioner by the authorities, which is an impediment to people who are self-employed in the healthcare system, particularly in respect of beauty parlours, massage and spa centers."
The counsel also drew the court's attention to a judgment by the Punjab and Haryana high court in the Sabnam Khatun case, where the petition was treated as a representation to be decided by the government.
Highlighting recommendations of the Haryana State Law Commission and policies issued by the governments of Delhi and Maharashtra, the petitioner's counsel emphasized the importance of "implementation of clear regulatory guidelines or policies" to allow self-employed operators to pursue their livelihood effectively and without undue interference.
