New Delhi, Oct. 10 -- The Supreme Court on Friday dismissed the Andhra Pradesh government's appeal against a high court order striking down its decision to restore 34% reservation for Other Backward Classes (OBCs) in local bodies, even as chief minister N Chandrababu Naidu expressed dismay and promised to allocate more than 34% of Telugu Desam Party tickets to the OBCs, saying there would be no compromise on their representation.
"There is no compromise on providing political representation to the backward communities. On behalf of the Telugu Desam Party, we will allocate more than 34% of the party tickets to the OBCs and ensure their victory," Naidu said.
A bench of justices Dipankar Datta and Sheel Nagu remained unimpressed by senior counsel Mukul Rohatgi's submissions that the state's decision was backed by demographic and empirical material, pointing out that the high court had examined the government's arguments in detail before concluding that the exercise did not meet the requirements laid down by the Supreme Court.
The bench said the HC correctly found the state's reliance on data from a unified family survey could not, by itself, provide the basis for granting the enhanced quota without the requisite empirical exercise to establish backwardness in the context of local body representation. Meanwhile, state election commissioner Anil Chandra Punetha said: "We are ready to issue the election notification as soon as the state government finalises the reservations for local bodies..."...
