Panchkula, Aug. 14 -- The municipal corporation (MC) Panchkula has sought to prepone the hearing of its appeal against a 2024 court order directing payment to M/s Avdesh Printers in a Swachh Bharat Mission-related dispute. MC took this step after the court of the civil judge issued warrants of attachment while hearing an execution application filed by M/s Avdesh Printers (plaintiff). The appeal, earlier listed for September 22, has now been sought to be advanced, with the court issuing notice to the plaintiff for August 18. No stay has been granted to MC in the appeal so far, informed the counsel for the plaintiff. The case stems from a decree passed by the court on November 21, 2024, in favour of M/s Avdesh Printers, Industrial Area Phase-1, through proprietor Avdesh Gupta. The plaintiff had approached the court in 2018, alleging that in September 2017, the MC officials verbally instructed him to urgently install flex boards across Panchkula to promote the Swachh Bharat Mission. Gupta claimed his quotation, offering the lowest rates, was accepted, and that the work was approved via emails, WhatsApp messages, and photographs. Despite submitting bills totaling Rs.24,02,681, he alleged that payment was withheld without justification. MC denied awarding the contract to M/S Avdesh Printers, maintaining that the official work order was given to another company. While admitting that some of the plaintiff's designs were used due to urgency, MC asserted that no quotation from him was formally received. After examining the evidence, the court had ordered recovery of Rs.24,02,681 with 6% interest from the date of the suit.
