SC flags rising false Pocso cases in marital disputes
New Delhi, May 30 -- The Supreme Court on Friday cautioned against what it described as the "uglier side of litigation", observing that a disturbing trend is emerging in matrimonial disputes where wives level false allegations of sexual assault against husbands involving their own minor daughters, leading to misuse of stringent criminal laws and adding to the mounting burden on courts.
A bench of justices BV Nagarathna and Ujjal Bhuyan made the observations while quashing criminal proceedings initiated under the Protection of Children from Sexual Offences (POCSO) Act against a man and his family members in a matrimonial dispute arising out of Meerut in Uttar Pradesh.
