India, July 19 -- India's criminal justice system is often discussed in terms of one number-the mounting backlog of criminal cases. The question most frequently asked is: How do we clear the backlog? It is a legitimate concern. Yet, it is not the most important one.

The more fundamental question is: How do we build a criminal justice system that prevents such backlogs from becoming a permanent feature of our democracy?
