Sri Lanka, Aug. 5 -- The Supreme Court had determined earlier that any Constitutional amendment to the retirement age or the period of office impacting on incumbent judges, whether directly or indirectly, will impinge on the independence of the judiciary and violate Article 3,which requires a Referendum.
The Court, in its previous determination regarding the Inland Revenue Bill, had mentioned it.
The matter has been brought to the fore in political circles in the wake of the Government insisting that there is no need for a referendum for the latest move by it to extend the retirement age of superior court judges. However, the Opposition insists that it should be referred for public approval through a referendum.
