RANCHI, India, Dec. 1 -- Jharkhand High Court issued the following order on Oct. 31:
1. Learned counsel for the petitioner submits that this revision has been filed under mistaken belief that against the impugned order of rejection of plaint, revision application is maintainable.
2. The true fact is that an appeal might have been instituted under Section 96 of the C.P.C. before the competent forum. As such, this revision petition is not maintainable.
3. Therefore, learned counsel for the petitioner seeks permission to withdraw this revision with liberty to file an appeal before the appropriate forum.
