HC issues notices to Guj Governor's office

Ahmedabad, Aug. 7 -- The Gujarat High Court today issued notices on a plea by a minister in Narendra Modi government challenging the sanction for his prosecution granted by Governor Kamla Beniwal in the alleged Rs 400 core fishing contract scam, overruling the Cabinet. Justice R H Shukla issued notices to Gujarat Government, private secretary of the Governor and Ishaq Maradia who had earlier sought sanction for Minister of State Purshottam Solanki's prosecution, while posting the matter for next hearing on August 14. Maradia had last week filed a complaint against the minister of state for fisheries in the ACB court of Gandhingar, which ordered the district SP to conduct an inquiry in the case and submit a report in two months.

The court also objected to averments made in Solanki's petition that can hurt the dignity of the post of Governor and ordered his lawyer Prakash Thakkar to delete them, to which he agreed. Solanki had last week moved the high court against the governor's decision of according sanction to prosecute him under the Prevention of Corruption Act while overruling the state Cabinet's decision. Referring to the Supreme Court judgement, Thakkar argued before the court that the governor can not take decision on her personal capacity without aide and advice of the council of ministers. Solanki had alleged that "the moment Her Excellency, Governor of Gujarat, had assumed the office she has tried to create several obstacles in the smooth functioning of the present government....
